What is Section 497 and How a Lawyer Handles this Case

The number of marital disputes in India has increased significantly. Section 497 of the Indian Penal Code introduces the adultery case where the married woman has affairs with an unknown man. Husbands can file this case against the women and the men he has a physical relationship with. In this blog, we will cover the details of Section 497 of the IPC and how a lawyer deals with this case.

Understanding Section 497

This is a case that comes under the adultery as a criminal offence in India. It is made to punish the men who are engaged in consensual extramarital physical relationships with a married woman. The woman who is involved will not be penalised or treated as a participant in the crime. The punishment for the male could be imprisonment for up to five years or some monetary fine.

 

This case is gender specific. The husband of the woman has the power involved in the case and has the power to punish the man. The woman is safe and she will not be punished. The Supreme Court introduced this section to keep an individual’s fundamental rights. The decision of the judgement brought equality to the personal relationship within the legal system.

Role of a Lawyer in Section 497

While adultery is not a criminal offence, but involves divorce proceedings. The lawyers deal with the case with the legal provisions and present a clear overview.

1. Initial Consultation

The lawyer first listens to the husband carefully and gathers the information. They wanted to know if the woman received some blackmailing threats or not. The lawyer also wants to know if the husband needs a certain divorce or not. After listing all the history they will start creating the documents for filing the case. This consultation also makes clear whether the client wants to take the case to court or not. If they want to settle outside the court then the lawyer also helps in that situation.

2. Gathering evidence

The lawyer then starts to collect evidence while they also keep some private detectives to collect evidence. They have access to collect data from WhatsApp chats to any social media activities. Lawyers also gather testimonials that are close to the family. Evidence like the physical report of the women and the men are also crucial to present if some physical relationships have happened. This test needs proper documentation and the lawyers can manage that.

3. Building Strategy

After collecting all the evidence they started to build the strategy to fight the case. The opposition lawyer also submits the evidence and the list of witnesses. They can build a case to protect the financial interest of the client. They make sure that the criminal gets the perfect punishment for the crime and the rights of the women are also protected. 

4. Negotiation with the Accused

The council and the accused if guilty then the lawyer of the client makes the negotiations. They provide the documents and the mental health report of the client to make a more punishable case for the accused. They may cross-examine the opposition and deal with the monetary punishment also.
