What is Bail?

Bail is the temporary release of an accused person awaiting trial, often on the condition of a financial guarantee or bond. It ensures the individual returns for court proceedings while avoiding unnecessary detention.

Types of Bail in India

  1. Regular Bail – Granted to a person already under arrest.

  2. Anticipatory Bail – Granted in anticipation of arrest, protecting the person before detention.

  3. Interim Bail – Temporary bail granted before a regular or anticipatory bail hearing is finalized.

Legal Basis for Bail

The concept of bail in India is rooted in the Code of Criminal Procedure (CrPC). The court considers various factors before granting bail, including:

  • Nature and seriousness of the offense

  • Past criminal record

  • Possibility of the accused fleeing justice

  • Potential to tamper with evidence or influence witnesses
