    • Section 8 prohibits the production, manufacture, possession, sale, transport, or consumption of narcotics and psychotropics, except for medical or scientific purposes.

    • The Act prescribes severe penalties depending on the quantity of the substance:
      • Small Quantity: Up to 1-year imprisonment or fine, or both.
      • More than Small but Less than Commercial Quantity: Up to 10 years imprisonment and fine up to INR 1 lakh.
      • Commercial Quantity: Rigorous imprisonment of 10 to 20 years and fine between INR 1 lakh and INR 2 lakh.
  3. Bail Provisions:
    • Section 37 makes bail stringent for offenses involving commercial quantities or repeat offenders. Bail can only be granted if the court is satisfied that the accused is not guilty and is unlikely to commit an offense while on bail.
  4. Addiction Treatment:
    • Section 64A provides immunity to addicts volunteering for de-addiction treatment, subject to court approval.
  5. Confiscation of Property:
    • Property derived from or used in drug-related offenses can be confiscated under Section 68.

Procedure in NDPS Cases

    • Cases typically begin with the seizure of drugs and registration of a First Information Report (FIR).

  4. Trial:
    • NDPS cases are tried in Special Courts. The prosecution must establish the chain of custody and compliance with procedural requirements to secure a conviction.
