Best Lawyer for Bail Cases in Delhi

The concepts of bail and anticipatory bail relate to securing an individual’s temporary freedom in criminal proceedings but differ significantly in their purpose, timing, and legal framework. Here’s an explanation of the differences:

1. Bail

  • Definition: Bail is a process by which a person who has been arrested is temporarily released from custody, typically by furnishing a bond or surety, while ensuring their appearance in court when required.
  • When Granted: Bail is sought after a person has been arrested.
  • Purpose: To secure the accused’s release while ensuring they attend court hearings and do not interfere with the investigation.
  • Types of Bail:
    • Regular Bail: Granted for someone already in custody.
    • Interim Bail: Temporary bail granted pending a final decision on the bail application.
  • Who Grants It: Typically granted by a magistrate or court.

2. Anticipatory Bail

  • Definition: Anticipatory bail is a legal provision that allows a person to seek protection from arrest in anticipation of being accused of a crime. It ensures that the person is not taken into custody in the first place.
  • When Granted: Sought before an arrest is made, usually when a person anticipates that they may be falsely implicated or accused.
  • Purpose: To prevent the arrest of a person who apprehends being charged with a non-bailable offense.
  • Key Section: Governed under Section 438 of the Criminal Procedure Code (CrPC) in India.
  • Who Grants It: Typically granted by a sessions court or a high court.

Key Differences at a Glance:

Aspect Bail Anticipatory Bail
Timing After arrest Before arrest
Purpose To release a person in custody To prevent arrest
Who Can Apply Arrested individuals Individuals apprehending arrest
Jurisdiction Magistrate, sessions court, or high court Sessions court or high court
Applicable Offenses Generally after charges are known Non-bailable offenses

In summary, bail comes into play after an arrest, while anticipatory bail is a preventive measure sought to avoid being arrested.
